  • COLOBERTI & LUPPI, a subsidiary company of LUPPI & CRUGNOLA, was born in 2011, has been incorporated to take over the Milan-based Firm of Ing. Coloberti, well-known for both the expertise in the patent sector and the technical consultancy at court of law.

  • Luigi Luppi founded the firm LUPPI & CRUGNOLA in 1996.

    He graduated in Mechanical Engineering from Bologna University, was a member of the Italian Group of A.I.P.P.I., a member of the College of Industrial Property Consultants of the F.I.C.P.I., a member of the Examination Committee II (Electrical and Mechanical Engineering) of the European Patent Office that examines candidates for admission to the Register of European Patent Attorneys.

    He was well-known as an author of essays and studies relating to intellectual property and was an outstanding patent attorney throughout his professional career. Until 2007, the year of his tragically early death, he supervised, coordinated and directed the firm's activities as well as providing clients with legal and technical assistance on patent and intellectual property matters.

  • LUPPI & CRUGNOLA was incorporated in 1996 by the initiative of Ing. Luigi Luppi. The firm rapidly grows up in turnover and staff and soon opens new offices in Milan and Bologna.

    Regime fiscale opzionale di tassazione agevolata dei redditi derivanti dall’utilizzo diretto e indiretto dei beni immateriali, ovvero brevetti per invenzione e modelli di utilità, marchi, disegni e modelli, copyright per software, informazioni aziendali giuridicamente tutelabili.

    Ha durata quinquennale, è irrevocabile e rinnovabile ed è rivolto a tutti i soggetti (persone fisiche o giuridiche) titolari (o aventi diritto allo sfruttamento economico) di beni immateriali e di redditi d’impresa soggetti ad imposta in Italia, che esercitano attività di ricerca e sviluppo.

    La somma agevolabile corrisponde al prodotto tra reddito derivante dall’utilizzo dei beni immateriali e rapporto tra i costi di ricerca e sviluppo sostenuti ed i costi complessivi per la produzione dei beni stessi.

  • Bando Marchi+2

    Il bando MARCHI+2 prevede agevolazioni, a favore delle micro, piccole, e medie imprese con sede legale ed operativa in Italia, per favorire la registrazione di marchi comunitari presso l’UAMI e di marchi internazionali (primi depositi o estensioni posteriori) presso l’OMPI, a copertura delle spese di progettazione del marchio, ricerca, deposito e assistenza legale, sostenute nel periodo compreso tra il 1° febbraio 2015 e la data di presentazione della domanda di agevolazione.

    Ogni impresa può presentare più richieste di agevolazione, sia per la registrazione di marchi comunitari che per marchi internazionali, fino al raggiungimento del valore complessivo di Euro 20.000.

    Le domande di agevolazione potranno essere presentate a partire dal 1° febbraio 2016 e fino all’esaurimento delle risorse disponibili.

    Il bando DISEGNI+3 prevede agevolazioni, a favore delle micro, piccole, e medie imprese con sede legale ed operativa in Italia, per la valorizzazione di disegni/modelli registrati a copertura di spese ancora da sostenere per le fasi di produzione e/o commercializzazione.

    Ogni impresa può presentare più richieste di agevolazione, aventi ad oggetto un diverso disegno/modello registrato, fino al raggiungimento del valore complessivo di Euro 120.000.

    Le domande di agevolazione potranno essere presentate a partire dal 2 marzo 2016 e fino all’esaurimento delle risorse disponibili.

  • Verso una disciplina uniforme del segreto commerciale: approvata la Direttiva UE 2013/0402

    Il 14 aprile 2016 il Parlamento Europeo ha approvato la Direttiva 2013/0402, sulla “protezione del know-how riservato e delle informazioni commerciali riservate (segreti commerciali) contro l’acquisizione, l’utilizzo e la divulgazione illeciti“.
    La direttiva introduce una definizione comunitaria di segreto commerciale, nonché misure e strumenti di tutela rapidi ed efficaci contro l’acquisizione, l’utilizzo e la divulgazione illecita di un segreto commerciale. Importanti novità attengono, inoltre, ai criteri di quantificazione del danno che dovrà tenere conto anche del pregiudizio morale arrecato all’impresa danneggiata.
    I paesi UE avranno due anni di tempo, a partire dalla data di pubblicazione della nuova direttiva, per adeguare le norme nazionali sulla protezione dei segreti commerciali alla nuova direttiva UE.

    L'articolo 28.8 del Regolamento sul Marchio dell’Unione Europea (ex marchio comunitario) dà la possibilità, ai titolari di marchi UE depositati prima del 22 giugno 2012 e registrati in relazione all'intero titolo di una classe della classificazione di Nizza, di precisare l’ampiezza della portata della loro registrazione.
    Tale disposizione transitoria si estende anche alle registrazioni internazionali designanti l’Unione Europea e che soddisfano le condizioni di cui sopra.

    Founding partner of the firm COLOBERTI & LUPPI (2011).

    B.S. in Electrical Engineering (Polytechnic of Milan, 1967).
    Profile: 

    After graduating, he started work as an IP consultant in one of Milan’s most important firms, where he dealt with translations, drawing up patent and model applications and the examination procedures for foreign applications. Since 1978, he has had his own IP firm in Milan; over his career he has often been called on as an expert witness in civil and criminal cases in Italy and has also often acted as a court-appointed expert. In 2011 he became a founding member of Coloberti & Luppi Srl, of Milan, where he continues to work.

Emidia has also been a member of the examining committee of the Civil Law and IP Law Chairs at the University of Bologna and has been the author of articles and comments.     Prior to joining Luppi Crugnola, Fabio worked for well known Italian IP firms, gaining more than 30 years of experience as a patent attorney. In one of these firms he was responsible for the patent area, managing and coordinating a team of patent agents. He organized and hosted seminars on Industrial Property in Italy, USA, China, Korea and Japan. Fabio is often consulted by Italian Judges as an expert witness in civil and criminal cases and his expert opinion is frequently sought by the Guardia di Finanza (Financial Police) in investigations and actions against counterfeiting. He is a member of the Experts Committee of the Intervention Service of the Fiera di Milano. Fabio deals with all matters regarding patents and designs, including searches, preparation, prosecution, technical opinions, oppositions, litigation.

She has been appointed (2012-2015) as an Expert for the international protection of the Intellectual Property for Unione Camere Lombarde. Angela is a writer of IP publications and comments on various reviews published by ILSOLE24Ore. She mainly deals with the legal and judicial proceedings and in particular with all the pleadings and measures in the IP field, assisting and representing the clients before the specialized Courts and attending at the hearings, including the precautionary measures, the prejudicial and settlement phases and the Expert Opinions proceedings.
